I occasionally text my friend Lacy Williams, she is an alcoholic in
anchorage. I recently talked to her on my birthday, I already explained
to her in advance that I would periodically try to reach her to make
sure she was OK. She seemed fine with this. She has never asked me to
not stay in contact and has actually taken steps to make sure I still
have a current number for her, even though I have not seen her in about a
year now. She goes through phones so I am surprised every time I can
actually get threw to her. When she talked to me on my birthday she said
"I love you" I just left a text on her phone and told her to contact me
cause I want to hear from her voice that she was doing ok. She told me
she was living in her truck in anchorage. Shortly after that I received a
call form Bethal. I do not know anyone in Bethal. I came back to my
phone and found that in fact she did call me. I hesitated because I care
for her I don't want to annoy her with my calls. But she called me and I
so wanted to hear form her I am so worried about her, I get strange
feelings sometimes when things go wrong. And I was having a bad feeling
so I RETURNED HER PHONE CALL. a MAN ANSWERED I ASKED FOR LACY HE SEEMED
TO BE TALKING TO SOMEONE (LACY MAYBE) BUT REFUSED TO PUT HER ON THE
PHONE AND STARTED QUESTIONING ME I TOLD HIM WHO I WAS AND HE SAID THAT
IF I EVER CALLED HIS FIANCE AGAIN HE WOULD HUNT ME DOWN AND KILL ME. I
hung up the phone immediately after saying that you can find me easily
and to "come and get me" Immediately he tries to call me back. I did not
answer, I went online and wrote this to inform you of what is
happening. I have the phone number, and you can check phone records, if
you can get a recording of him threatening me I would like to press
charges, IN FACT I'LL PRESS CHARGES AS SOON AS YOU GIVE ME HIS NAME! I DO NOT KNOW WHO THIS MAN IS. I BELIEVE HE IS ABUSING LACY
WILLIAMS.
Penal Code 422, criminal threats,
is a "wobbler" that can be charged as a misdemeanor or a felony. As a
felony, is carries up to three years in state prison, and a misdemeanor
has a maximum of a year. A felony 422 conviction is also a "strike"
under the Three Strikes law, which can increase the punishment for any
future conviction.
"The Bane Act," provides protection threats
against federal statutory or constitutional rights with a penalty of six
months in jail and/or a fine not exceeding $1000. Speech alone is not
sufficient unless it threatens violence.
To convict someone of Penal Code 422, the prosecution must show the defendant:
1. Made a statement, intended as a threat;
2. To kill or seriously injure the victim or a member of their immediate family;
3. Causing the victim to fear for his or her safety.
